5. The entire site of 34 acres will be seeded according to the seed mix in the "temporary" revegetation plan
included in the file. Since the site is approved for apost-mining land use of "industriaUcommercial," it is assumed
that this revegetation is required only as a temporary measure to stabilize the site until actual development is
imminent. Obviously, if industrial development is to occur promptly after reclamation earthwork is completed, the
seeding will not have to occur first. The bond for that aspect of the reclamation, however, is required until such
development schedule is known.
6. I have included mobilization costs for a contractor from the Grand Junction area, since it is a likely and
reasonable assumption given the size of the contractor/equipment pool there.
Please review these tasks and costs, and notify me promptly if you notice any errors, omissions, or more efficient
methods to accomplish any tasks. You should inform me of any of these included tasks that have been already
completed, since reclamation performed can be excluded from the bond to be posted. Likewise, let me know if
there are questions about any of the figures in the packet.
By State statute, you are required to maintain a bond in an amount adequate to complete reclamation. This agency
is required to periodically review every bond for its adequacy, and notify the operator if additional bond is needed.
By law, you must provide such additional bond within 60 days of notification. Therefore, if you have any input or
questions, I must hear from you promptly so that a more accurate figure is determined within that timeframe.
To determine the start of the 60-day period, this letter and packet are being mailed via certified mail, with return
receipt requested. If you have need for new bond forms or have questions about types of bond instruments, please
contact Ms. Suzi Ericksen at the Division's Denver office (see letterhead).
I may be reached at the Division's Durango field office: 701 Camino Del Rio, Room 125, Durango CO 81301;
tel: 970/247-5193 or fax: 970/247-5104. I look forward to hearing from you.
Sincerely,
~~~ ~~~~
Bob Oswald
Environmental Protection Specialist
encl: bond recalculation packet.
CERTIFIED MAIL NO. 7099 3220 0002 8956 5517
Return Receipt Requested
cc (w/out encl): Suzi ericksen, DMG
(a:\orchgrove fwl/rco)
