~,;~. <br />ORIGINAL-PUBLSC FILE <br />(Page 2) <br />MINE ID # OR PROSPECTING ID #: ~e-~ 9ft8-m a <br />INSPECTION DATE: 1J7/mms INSPECTOROS INITIALS: -8K_ <br />OBSERVATION <br />The Division conducted a monitoring inspection of the site on 10/07/05. The site is a large 112 sand and gavel <br />operation with a permit acreage of 224.70 and maximum affected acreage of 39acres. The site is <br />approximately 15 miles South West of Colorado Springs, along the West side of High Way I-25. Present during <br />the inspection was Mr. Joe Baxter of Kirkland Construction, the current operator. The active mining area is <br />divided into a north and South side. According to Mr. Baxter mining along the south side is completed, the only <br />activity on the south side is removal of material from already stockpiled material. Pit walls have been graded to <br />a slope gentler than 3:1 to almost flat. The active mining area is located along the North side. When Kirkland <br />Construction succeeded the operation in 1997, they agreed fo stay with in the 39 acres of area that was <br />already affected. Since that time all the activity has been along the North side of the permit, affected <br />acreage. The active pit slopes were stable. Depth of the pit ranged from 3 feet along the East side to <br />approximately IO feet along the North West Side. Because of trespassing in the area, operator had placed a <br />new fence around the entire permit area, now divided by a County Road for the new development adjacent <br />to the permit area. <br />Both the North and South side affected acreages were walked; driven and inspected, permit sign properly <br />posted. The existing warranty of $40,000 is more than adequate to cover the cost of recalamtion. However, as <br />discussed with Mr. Baxter during the inspection, if the current affected acreage is increased, an additional <br />"~ warranty will be needed to cover the cost.
