The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116,
Pazagraph 4, of the Colorado Revised Statutes, that on September 23, 2004, an application to revise coal mining
operations at the Bear Mine was considered complete for the purposes of filing. The revision was submitted by
Bear Coal Company, Inc. All review and comment periods as provided in the Act and the Regulations initiate
from this date of filing.
In Technical Revision No. 28, the Bear Coal Company is proposing to discontinue the hydrologic monitoring of
three natural springs in the Lone Pine Gulch area. The Bear No. 3 Mine is a reclaimed mine that ceased mining
operations in late 1996. The Bear Coal Company has not mined in the Lone Pine Gulch area for about ten years.
Other hydrologic monitoring at the Bear No. 3 Mine will continue.
The underground coal mining operation is on land located approximately 0 miles East of Somerset. The permit
area is further described as follows:
Portions of Sections 8, 9, and I5; all of Section l6; portions of Sections 17, 18, 20, and 21 Township 13 South,
Range 90 West of the 6th P.M.
The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Somerset.
Because the above referenced technical revision application would alter previously approved permit conditions or
mitigation measures, we are requesting your agency's evaluation of the proposal. Your comments and concerns
relating to the adequacy of fish and wildlife resources information, the fish and wildlife plan, and the reclamation
plan as it relates to fish and wildlife considerations, including potential impacts to threatened or endangered
species, are requested.
