Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116, <br />Paragraph 4, of the Colorado Revised Statutes, that on September 23, 2004, an application to revise coal mining <br />operations at the Bear Mine was considered complete for the purposes of filing. The revision was submitted by <br />Bear Coal Company, Inc.. All review and comment periods as provided in the Act and the Regulations initiate <br />from this date of filing. <br />In Technical Revision No. 28, the Beaz Coal Company is proposing to discontinue the hydrologic monitoring of <br />three natural springs in the Lone Pine Gulch area. The Bear No. 3 Mine is a reclaimed mine that ceased mining <br />operations in late 1996. The Bear Coal Company has not mined in the Lone Pine Gulch area for about ten yeazs. <br />Other hydrologic monitoring at the Beaz No. 3 Mine will continue. <br />The undergound coal mining operation is on land located approximately 0 miles East of Somerset. The permit <br />area is further described as follows: <br />Portions of Sections 8, 9, and 15; all of Section 16; portions of Sections 17, 18, 20, and 21 Township 13 South, <br />Range 90 West of the 6th P.M. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Somerset. <br />Because the above referenced technical revision application would alter previously approved permit conditions or <br />mitigation measures, we are requesting your agency's evaluation of the potential for impacts to threatened or <br />endangered species of plants or animals, or wildlife species otherwise protected by federal law. <br />In order for us to approve this revision, we aze required to make a fmding that "the activities would not affect the <br />continued existence of endangered or Uueatened species or result in the destruction or adverse modification of <br />then critical habitats as determined under the Endangered Species Act of 1973...." We request your review and <br />recommendation pursuant to this finding.
