Discontinue Lone Pine Gulch Spring Monitoring

The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116, Paragraph 4,
of the Colorado Revised Statutes, that on September 23, 2004, an application to revise coal mining operations at the Beaz Mine
was considered complete for the purposes of filing. The revision was submitted by Beaz Coal Company, Inc.. All review and
comment periods as provided in the Act and the Regulations initiate from this date of filing.
In Technical Revision No. 28, the Bear Coal Company is proposing to discontinue the hydrologic monitoring of three natural
springs in the Lone Pine Gulch azea. The Beaz No. 3 Mine is a reclaimed mine that ceased mining operations in late 1996. The
Beaz Coal Company has not mined in the Lone Pine Gulch azea for about ten years. Other hydrologic monitoring at the Beaz
No. 3 Mine will continue.
The underground coal mining operation is on land located approximately 0 miles East of Somerset. The permit area is further
descnbed as follows:
Portions of Sections 8, 9, and 15; all of Section 16; portions of Sections 17, 18, 20, and 2] Township 13 South, Range 90 West
of the 6th P.M.
The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Somerset.
The applicant is required to publish notice in a local newspaper that this application has been deemed complete. At the time of
publication of this notice, [he applicant is addifionally required to place a copy of this application at the Paonia Public Library,
140 Grand Avenue, Paonia, CO 81428and at the Division office. For additional information or to provide written comments,

order for us to comply with regulatory time frames, we request that comments be submitted within fifteen (IS) days of this
letter If no comments aze received by then, we will proceed on the assumption that you have no concerns with, or objections
to, the applicants proposal.
