Long <br />Division Director <br />On January 19, 1995, the Division received a request from you for <br />a formal hearing regarding the above referenced technical revision. <br />On January 20, 1995, I phoned you to schedule the hearing for the <br />next regularly scheduled meeting of the Colorado Mined Land <br />Reclamation Board (CMLRB) in accordance with Rule 2.08.4(5)(b)(ii) <br />of the Colorado Mined Land Reclamation Board for Coal Mining. The <br />next regularly scheduled meeting of the CMLRB is Wednesday and <br />Thursday, January 25 and 26, 1995. <br />During our phone conversation, you expressed the following <br />concerns: <br />1) That the proposed decision was not on file at the <br />Garfield County Courthouse, and <br />2) That you believed the formal hearing could be delayed to <br />February because of the short period of time between when <br />you filed your request and the next regularly scheduled <br />meeting of the CMLRB. <br />With regard to your first concern, the Division does not issue a <br />"decision package" for technical revisions. Decision packages are <br />issued only for new permit applications, permit renewals, and <br />permit revisions. As you know, the proposed decision was published <br />in the Glenwood Post on January 10, 1995 in accordance with Rule <br />2.08.4(5)(11). Additionally, you were personally notified of the <br />proposed decision by mail on December 23, 1994 because of the <br />interest you had previously expressed regarding the technical <br />revision. Therefore, the Division finds that all the proper <br />notification channels have been followed. <br />
