Box 3609 Division Director <br />Grand Junction, CO 81502 <br />RE: COMMENT LETTER (Extended Comment Period) -United/Norwood Gravel Pit <br />Amendment No. 1 -File No. M-88-037 <br />Dear Mr. McGehee: <br />On October 21, 1996 the Division received, from William D. Harmsen, Jr., a letter of comment <br />(copy attached) regarding his right to an access easement that crosses your proposed gravel extraction <br />area. He states that he is somewhat flexible in the location of this easement; however, he does wish <br />to protect his right to it. <br />Although his easement was not of record when you submitted your application, we require that you <br />and Mr. Harmsen reach an agreement, regarding this easement and your application. Unless he is <br />willing to abandon it, you must preserve his property (easement) right in your proposed mining and <br />reclamation plans. To do this, you will have to change your application to accommodate the existing <br />easement or any agreed changes to the easement that your proposed mining and reclamation plans <br />may interfere with. <br />Please contact Mr. Harmsen, make any necessary agreements with him, and change your application <br />accordingly. This can probably be done with a technical revision to the application and should be <br />done as soon as possible. <br />Please call if you have questions. <br />Sincerely, <br />Larry D.
