Let me
assure you drat Schmidt has ao intention of operating in the new area, if the amendment is approved, until
the USR has been approved. Schmtdt decided, on the basss of this site being somewhat controversial, to
dcla}' application for the USR until they were able to see what kind of responses were received to the
Reelamanon Pem»t amendment, As rite objecnoa period ended Match 1 and no objections were received
from anyone, including the many other lessees on this property which were all noti5ed, it seems that it
might be appropriate to proceed with the IJSR application. I passed on to Scott Davis, Vtce President of
5chttudt, all the information you ptovtdcd to me regarding the applicrtion process. Although I might be
involved in the USR preparation to some degree, tt is not likely that (will be preparing that application as
my arch of cspertise does sot include the kind of detailed land use planning that Arapahoe County
teyuues. As for ~1r. Slanina's comments, Schmidt ss aware drat when peratits are acquired sequentially
rather titan concurrendy sometimes it is necessat}• to go back and make ad)ustments to a prior approval.
And eves when done concurcendy, in my experience, problems cv[th coalLcting requirements can occur. If
those lands of issues arise during the USR process, then they wiU be dealt with as needed.
Thank you for your communications and please don't hesttate to call myself regarding the Reclamation
Permit application or rcquircmcnts.
Sincerely,
~!~t~~
Tfark A.
