Further, the entrance will be buried by pit backfill during <br />the reclamation of the pit excavation to approved postmining topography. <br />Rule 4.23.2(4)(a) Each auger hole discharging water containing toxic forming or acid forming <br />material shall be plugged within 72 hours after completion by bacl~lling and compacting <br />non-combustible and impervious material into the hole to a depth sufficient to form a water-tight <br />seal or the discharge shall be treated commencing within 72 hours after completion to meet <br />applicable effluent limitations and water quality standards under 4.05.2 until the hole is properly <br />sealed; and <br />This item is not addressed in the application. Recommend the following adequacy comment: <br />"Please add to the discussion under paragraph 3.1 on page 12-4-2 a statement to the effect <br />that no toxic-forming or acid-forming water discharge is anticipated from the highwall <br />openings, with reference to the appropriate sources of such statements in the hydrologic <br />analyses provided for the respective coal seams in the Groundwater sections of the body of <br />the Permit Application Package. As a backup, please add "However, iftoxic-forming or <br />acid-forming water discharge is encountered, the opening of discharge will be backfilled <br />within 72 hours after completion" <br />Rule 4.23.2(4)(6) Each auger hole not discharging water shall be sealed as in 4.23.2(4)(a), to <br />close the opening within 30 days following completion. <br />If not waived under Rule 4.23.2(5), the application is not in compliance with this rule. If the <br />waiver is not granted, recommend the following adequacy comment: Please add to Paragraph <br />5.1 10 on page 12-4-3, that "However, no highwall entrance will be left open more than 30 <br />days." <br />Rule 4.23.2(5) An auger hole need not be plugged, if the Division finds: <br />I believe the Division can find such prerequisites to implement the waiver. If so, the application <br />might be modified as indicated below. <br />Rule 4.23.2(5)(a) Impoundment of the water which would result from plugging the hole may <br />create a hazard to the environment or public health or safety; and <br />If we engage this rule, recommend the following adequacy comment: "Please add to paragraph <br />3.1 on page 12-4-2 a statement to the effect that: "Flooding of the highwall holes is expected <br />as groundwater hydrologic regimes are re-established in the backfilled pits. These buried <br />impounded waters will not create a hazard to the environment or public health or safety. <br />Rule 4.23.2(5)(6) Drainage from the auger hole will not pose a threat of pollution to surface <br />water and will comply with the requirements of 4.05.1 and 4.05.2. <br />
