Brown and Frank R. Johnson, reference was made to an
intergovernmental law requiring revocation of a mining permit in
one state where there had been a prior termination of a mining
permit in another state. This applied to the question which was
raised concerning the termination of the mining permit held by Mr,
Collins or one of his companies in Missouri.
We were referred to 30 USCA 1201 as the source of this
law. We have reviewed this lava, being Public Law 95-87 and have
been unable to locate the specific provision in connection with the
reciprocity and requirement for termination. The law contains
Sections 1201 through 1328 and because of the lengthy nature it has
been impossible for us to review the same thoroughly.
--~ It would be appreciated if you or Mr. Frank Johnson of
the Attorney General's Office would refer us to the specific
provisions in the law concerning reciprocity and termination of a
permit for alleged violations in another state.
I am enclosing to you a copy of our letter to Mr. Fred
Banta setting forth our efforts to correct and resolve the problems
at the mine and also requesting a continuance of the hearing on the
proposed decision for denying a renewal of the existing mining
permit.
As stated previously, I will be away on vacation and it
will be impossible for me to attend the meeting and I would much
like to be there with Mr. Collins.
