.~ <br /> <br />January 14, 2005 <br />Mr. Jim Burnell <br />Environmental Protection Specialist <br />Colorado Division of Minerals and Geology <br />1313 Sherman Street, Room 215 <br />Denver CO. 80203 <br />gielsleo st yllo°ralc and Geology <br />Re: Oxbow Minine LLC, Permit No. C-1981-022 <br />TR-49 Application for Construction of Hubbard Creek Fansite. <br />Dear Mr. Burnell, <br />The purpose of this letter is to request Technical Revision No. 49 to the Oxbow Mining, <br />LLC (OMLLC) Permit No. C-1981-022 for construction and operation of the Hubbard <br />Creek fansite. <br />The fansite is located on previously disturbed lands associated with the reclaimed Blue <br />Ribbon Minesite (CDMG Permit # C-1981-047). The reclaimed Blue Ribbon Mine <br />(CDMG Permit C-1981-047) is located along Hubbard Creek. It is our understanding <br />that the minesite was closed and the disturbed surface (portals, shop, coal handling, etc.) <br />reclaimed in the mid-1980's. Blue Ribbon has continued to be monitored and maintained <br />under extended reclamation liability by the operator, MINREC Inc. until such time that it <br />is ready for final Phase II and Phase III release. In the interim, Phase I bond release was <br />successfully obtained in 1987. <br />The surface estate occupied by the reclaimed Blue Ribbon minesite is owned by Oxbow <br />Mining, LLC. The entire Blue Ribbon permit area already lies within the current <br />OMLLC permit area. <br />It is our understanding that once this application is approved by the Division, MINREC, <br />Inc. will follow-up with an appropriate revision to their Permit reflecting the transfer of <br />specific liabilities from MINREC, Inc. to OMLLC. <br />The site will be accessed via the existing Hubbard Creek road. The Hubbard Creek road <br />is a gravel road already in use by OMLLC to access the upper and lower Hubbard Creek <br />facilities from the former Somerset mine. The Hubbard Creek road is also used very <br />extensively by Bowie Resources, LTD to access their Permit area and the general public <br />to access lands managed by the BLM and USFS. <br />3737 Hwy 133 P.O.
