BOX 596 DwivonDirecior <br />Fort Morgan, Colorado 80701 <br />RE: Foiles Pit No. 2; File No. M-79-210; Amendment No. 1 <br />Dear Mr. Samples: <br />The Division received two separate letters requesting an extension <br />of time for the decision date for the Foiles Pit Amendment No. 1 <br />application. The latest letter requested an extension until July <br />12, 1996. The Division hereby grants the request. Once the <br />performance warranty reduction becomes final, we will proceed on <br />approving this amendment. If there are no objections, the release <br />should become final on July il, 1994. At that time the Division <br />anticipates making a decision to approve the amendment. <br />In order for this to occur timely, a clean copy of exhibit C should <br />be submitted which shows the latest (6/26/96) revisions on what is <br />being released, what is being removed from the expansion, where the <br />access road crosses through the southwest parcel, and exactly where <br />the permit boundary will lie upon approval of this amendment. <br />Those areas that are being released should remain on the exhibit <br />but be clearly marked so that it is understood what and where they <br />are. Perhaps cross-hatching or shading these areas will be the <br />easiest way of identifying them on the exhibit. <br />As previously mentioned, once the surety release comment period <br />elapses, and providing that the requested information is submitted, <br />a decision to approve the amendment will likely be proposed. <br />I you have any questions or require additional information, please <br />contact me. <br />S'n erely~ <br />lW\ S.. - <br />Anthony J.
