(BMRI) - San Luis <br />DMG Permit No. M-88-112 <br />West Pit Partial Backfill <br />Dear Mr. Oehler: <br />BMRI submitted to the Division on May 9, 1994 an app ication <br />for a modification to the current reclamation plan f~r the <br />West Pit at the San Luis Project. The proposed plan results <br />in eliminating one waste rock disposal area, reducin the <br />size of another waste rock disposal area, and provid ng <br />temporary waste rock storage at a third disposal are before <br />eventual removal and placement in the West Pit to pa tially <br />Backfill the Pit to allow free drainage of the area. <br />As previously discussed at a March meeting between B RT and <br />the Division, BMRI's opportunity to successfully imp ement <br />this modification had a narrow time frame. BMRI cle rly <br />stated in the May 9 cover letter for the proposed <br />modification that delays beyond July 31, 1994 would result <br />in waste rock material short falls that could alter the <br />proposal. <br />BMRI met with the local advisory panel, with Costill County <br />government representatives and with representatives f the <br />citizen's groups (Nora Jacquez and Roger Flynn) to p esent <br />the proposal. During these discussions, the modific tion <br />received a favorable response. The Division's May 1 letter <br />required BMKi to waive tiLe 30-day technical revision review <br />period and to publish a public notice in the Valley ~ourier, <br />four times, once a week for four consecutive weeks. BMRI's <br />letter dated June 22 provided proof of publication tp the <br />Division. Also, BMRI notified the appropriate owner of <br />record of lands adjacent to the San Luis Project; th~s <br />information was also provided to the Division. <br />As discussed with the Division during a telephone <br />conversation on August 16, BMRI has altered producti n <br />schedules during early August awaiting approval of t~e <br />modification.
