November 16, 1994.
Ms. Susan Burgmaier
Reclamation Specialist
Colorado Division of Minerals and Geology
1313 Sherman St:, Room 215
Denver, CO 80203.
Co. mine at the Coal Mew Ranch
Dear Ms. Burgmaier.
RE: Post reclamation land use of the Sun .Coal
According to the Information I have been sent by Sun Coal Co., regarding the facilities to remain
on the John Ellts ranch, It is my understanding that the buiidings to remain from the mining
operation include the office trailer, truck. scales and scale house, electrical poles and transformers,
a weather station, the bridge over the Yampa River, a conveyor gallery over the Yampa River, a
coal recovery tunnel; a crusher pit covered with a metal shed, the shop buildings and storage
tanks. There are also two water wells that are to.be transferred to Mr. Fits. It is also my
understanding that the haul road will remain for use of the landowner.
According to the technical revision Information, these facilities were. to remain as per the District
Court Order and Settlement Agreement from 1983. While It Is our understanding that the
landowner has.the right to request that certain facilities be left in place offer mining has been
completed in any area, it must be clarified and understood that the facilities to be.leff in place
are for the sole use of the landowner, and that these facilities must be related to the agricultural
operation of the ranch. The designation of "light industrial" Is not a County Zoning designation,
nor do we apply such designation to any other.mining facilities in Rouff County.
Therefore; the facilities that remain in place would be acceptable to Routt County. if we are
certain that the use of those facilities are for the landowner on his own property, for agricultural
purposes, or as an approved part of an active use permit. According to our records, there is an
active permit for snowmobile tours on the property; as well as permits for various oil wells. Any
other mining, commercial, or industrial uses of the property would have to first be reviewed by the
County pnd appropriate approvals would have to be obtained prior to any operation.
Please contact this office 1f you have any further questions regarding this matter.
Sincerely,
~g~
Caryn Fox
Staff Planner
cc: Bryan Archer, Sun Coa! Co.
Michael Savage, Savage and Savage
