February 14, 1000 <br />Page 2 <br />In pazagraph three Mr. Mangone states that in the flood of 1999 the water <br />flowed over the road and the road remained complete and passable as the <br />water spilled over to the opposite side of the road as it continued down <br />stream. This statement is completely false. We provided Anita Culp with <br />pictures showing Red Creek was diverted into a sepazate stream channel that <br />flooded our property. We have enclosed these pictures showing the diversion <br />of Red Creek. <br />In pazagraph four Mr. Mangone states that the second crossing which <br />includes the culvert neaz Bob Stack's gate is a drain pipe for run off from the <br />east side of the road and carries water to the natural drainage on the west side <br />of the road. This statement is not completely true. The water from the east <br />side of the road is not just drainage but in fact the actual streambed. The <br />natural channel of Red Creek used to run on the East side of the road <br />crossing in front of the quarry ranch entrance and still does during flood <br />events. We have Anal photos showing the diversion of Red Creek in several <br />stages one being the ditching on the west side of the quazry access road. <br />Thus proving this statement by Mr. Mangone to be false. We can provide <br />copies of these pictures and a statement from a professional hydrologist <br />substantiating this information. <br />Also in pazagraph four Mr. Mangone states that the roadway is designed to <br />allow water to sheet across the top of asphalt. If this is true why was it <br />necessary to put a culvert in at all. <br />In pazagraph five Mr. Mangone states that the flow across the road is not in <br />fact Red Creek. This is obviously a false statement given the information <br />provided previously. <br />Pazagraph five also states that the drainpipe installed in 1997 has effectively <br />handled the extreme floods and operated as designed even during the 1999 <br />floods. This statement is also false. The drainpipe was completely blocked <br />and we have pictures of red creek being diverted onto both sides of the quarry <br />access road. <br />In paragraph six Mr. Mangone states that each rain fall exceeded 20 inches. <br />We would like to see proof of this since we have contacted several rain <br />stations in our area and none of them reported such incredible amounts of rain <br />Ft Carson and local areas around Canon City and Colorado Springs <br />substantiate this. Our hydrologist has documented these measurements and <br />we can provide this information. <br />We believe that the amount of rain over the last few years should not be <br />considered unexpected rain events. We believe given the history of flooding in <br />this azea the events of 1999 are not totally unusual and should have been <br />
