IX. ROAD MAINTENANCE RM will maintain all the mill access roads and ancillary equipment in good operating condition. X. TAILINGS The tailings resulting from milling of Cripple Creek ore (Little Hope Mine) will remain in the Lucky Strike Tailings Impoundment and will become the sole property of SLSM. RM forefeits any future profits or liabilities stemming from these tailings. XI. NOTICES All notices and other communication to either party shall be in writing. INSTRUMENT All covenants, conditions, limations, and provisions contained in this lease apply to and are binding on the parties to this lease, their heris, representatives, successors, and assigns. XIII. DISPUTE RESOLUTION Any dispute, controversy, or claim arising out of or relating to this Agreement shall be finally settled by arbitration in Colorado Springs, Co. in accordance with the Commercial Arbitration Rules of the American Arbitration Association in effect on the date of this Agreement (though not necessarily conducted through said Association.) Judgment upon the award rendered by the arbitrator may be entered in any court having ,jurisdiction thereof ___ _ X'IV ADDITIONAL DOCUMENTS SLSM shall rpovide RM with Colorado MLRB Permits for the Lucky Strike Mill. RM will be responsible to stay within the requirements of_ these permits and be responsible for all MSHA Regulations and Safety violations. SLSM shall provide RM with such additional documents as may be necessary to carry out the purposes of this Lease. If conditions change by reason of acquisitions, conveyances, assignments, or other matters relating to the title to or description of the Property, SLSM and RM shall execute amendments to this Lease and the Short Form of this Lease, and any other documents which may be necessary to reflect such changed conditions.
