TNAn <br />RE: Tamarisk and Russian Olive Management at Permitted Mine Sites <br />This policy supplements the Board approved Weed Control Poficy, dated July 1T, 1498 sad <br />revised 1/LMQ2, and 10l2til02. This policy paiRaina lust to tamarisk (salt cedar) end Russian <br />olive. <br />As we developed this amendmem to the Board's Weed Poficy, we received input from industry <br />associadotm, state weed experts, the Office of the Executive Director, DepattmeDt of Natural <br />ResourDea, the Attorney OeneraI's OtHoe (A04) and Office stab; We appreaciata and thank <br />those that provided comments aad auggeations. <br />Our existing Weed Control Policy addresses noxious weeds sad provides guidance for mine site <br />control atrdlor eradication of noxious weeds. The policy currently excludes tamarisk or Russian <br />olive. However, theca species are now infestation problems on ~tne permitted sites. <br />When tamarisk asxilor Russian olive occur and the State Wad Rules lid require eradication <br />tram the region in which the mining operation ascots, the Board directs the DMG to process <br />reclamation liability release requests if: <br />1.. The release area was in reclamation prior to January 19, 2001 (graadfathcred); and <br />2. acceptable evidence is provided to the Division that the approved reclamation plan has <br />ban fitlly implemented; and <br />3. the release area satisfies all other provisions of the Act, Rules and Regulations, and the <br />approved permit application. <br />However, where tamarisk attd/ar Russian ollva are the sole source for infestation on to adjacau <br />propaiies that are ttte of tsmariak and/or Reasian olive, these pleura shall bo eradicated just as <br />any albs nordous weed would be required to be eradirxtM from reclaimed areas under these <br />eircumstences. <br />qRa ~ oala a colarado <br />Mined land RttttanWlan MT.e aM taapive MltKS Geolopcal Swvey <br />
