The Review Process <br />The Sanborn Creek Mine, operated by Pacific Basin Resources, is located in Delta and <br />Gunnison Counties, and is adjacent to the town of Somerset on State Highway 133. The <br />Eastern Lease Modification, Right-of-Way, and permit boundary adjustment are the subject <br />of this permit revision. The permit revision will add approximately 3,518 acres to the permit <br />azea, but will not increase the allowable surface disturbance. The total approved permit <br />azea will be 9,047 acres. <br />Approval of this revision will include an additional 160 acres of mining area within modified <br />Federal Coal Lease No. COC-53510. <br />The permit boundary adjustment was necessitated by recently revised Rules 1.04(89) and <br />2.03.6(1), which require a detailed legal description of the entire permit area. The <br />previously approved permit azea could not be easily described in the detail now required <br />by the Division. <br />The operator initially applied for approval of mining through the 40 acre right-of-way area, <br />but subsequently revised the application and will not be mining the right-of-way. The <br />previously designated right-of--way area (Lot 1, Section 12, Township 13 South, Range 90 <br />West) will, however, remain within the permitted area. <br />The original permit under the Colorado Permanent Regulatory Program was issued to U.S. <br />Steel Mining Company, Inc. on October 11, 1983. Kaiser Coal Corporation acted as <br />operator on the property from 1986 to 1990. In 1990, the permit was transferred to <br />Somerset Mining Company and renewed for another five-year permit term. Upon <br />finalization of the purchase of the mine and transfer and renewal of the permit, Somerset <br />Mining Company proposed opening a new set of mine portals to access the B and C coal <br />seams. This proposal was presented in the form of Permit Revision No. One (PR-O1) <br />submitted to the Division on June 4, 1990 and approved on March 27, 1991. The present <br />permit period runs from October 11, 1993 and expires on October 11, 1998. The permit was <br />subsequently transferred to Pacific Basin Resources August 31, 1995, at which time the mine <br />name was changed to Sanborn Creek Mine. At the time of this proposed decision, the <br />Division is presently reviewing an application to transfer the Sanborn Creek Mine permit <br />to Oxbow Cazbon & Minerals. <br />Permit Revision No. 3 (PR-03), the subject of this Findings Document, was submitted to the <br />Division on May 13, 1996. The application was deemed complete on May 23, 1996. Pacific <br />Basin Resources published its notice of the revision application in the Delta County <br />Independent on June 5, 12, 19, and 26, 1996. <br />This "Findings of Compliance" document has been updated to reflect existing conditions and <br />$antarn Crcek Mine 5 Permit Revision No. 3 <br />
