12. The Hubbard Creek Pond and East Yard Pond both remain intact. <br />One additional pond is approved for treatment of underground <br />discharge from the Sanborn Creek Mine. Specific plans are found <br />within Appendix B of the permit document. All ponds are designed <br />in compliance with Rule 4.05.6. <br />E. Acid-forming and Toxic-forming Spoil <br />1. There is no evidence of acid- or toxic-forming material at this site. <br />F. Impoundments <br />Refer to Section D, Sedimentation Ponds, above. <br />G. Surface and Ground Water Monitoring <br />1. The applicant will conduct monitoring of ground water in a manner <br />approved by the Division. The ground water monitoring plan is <br />specified on Page 2.04-46i of the permit document (4.05.13(1)). <br />2. The applicant will conduct monitoring of surface water in a manner <br />approved by the Division. The monitoring plan was submitted under <br />2.05.6(3)(b)(iv) and as specified on page 2.04-46i of the permit <br />document (4.05.13(2)). <br />I. Discharge of Water into an Underground Mine <br />Discharge of water to underground workings will not occur. <br />Stream Buffer Zones <br />The Division has approved surface and underground mining activities <br />within 100 feet or through perennial streams. This decision was based <br />on a finding that on Hubbard Creek the original stream channel will <br />be restored, water quality and quantity shall not be adversely affected, <br />and appropriate riparian vegetation will be reestablished. On the <br />North Fork of the Gunnison, the decision was based on the fact that <br />the original stream channel would not be affected and water quality <br />and quantity would not be adversely affected. The buffer zone <br />variance was granted for the areas located at the stream crossing and <br />pre-law bench area at the lower Hubbard Creek site and the topsoil <br />stockpile at the upper Hubbard Creek site. The buffer zone variances <br />on the North Fork of the Gunnison are located at the alluvial well and <br />leach fields just above and below the town of Somerset (4.05.18(1)). <br />Sanborn Cteet Mine 17 Petmit Revision No. 3 <br />
