December 5, 2004 <br />Bromley AR-002 <br />Page 2 of 2 <br />The post-mining land use in the approved reclamation plan is for (unsealed) open <br />lake/wildlife habitat. As you can see, the City wishes to implement a different post- <br />mining land use. Both parties seek a way to efficiently accomplish the City's desired end <br />use. Causing Ready Mixed to perform reclamation under the DMG permit that maybe <br />inconsistent with the City's future plans and/or immediately destroyed by the City's <br />construction activities makes little sense. To further simplify and expedite this request <br />from an administrative perspective, Ready Mixed is not, at this time, seeking a bond <br />reduction in conjunction with this Acreage Reduction request. <br />To support this request, we have attached a new Exhibit A -Legal Description for <br />incorporation into the revised pennit. This in turn is supported by a map showing the <br />new configuration of the permit boundary per the proposed new legal description. These <br />attachments indicate that the proposed new permit area will comprise approximately <br />172.5 acres and that a total of 220.0 acres will be released from the permit. <br />One detail of interest is that the acreage to be released per this request is in two halves <br />that will comprise the City's Cell No. 1: the easterly half comprising approximately 49.5 <br />acres and a westerly half comprising approximately 170.5 acres. The land between these <br />halves will constitute a "land bridge" from the Bromley Lakes Pit (this permit) to an <br />adjoining Ready Mixed property called Erger's Pond Pit ((DMG Permit M-1998-036). <br />Erger's Pond Pit is currently unmined and has no separate access or haul routes. Under <br />the approved Erger's Pond permit, material mined there is to be processed at the existing <br />Bromley Lakes Pit plant facilities. Once Erger's Pond is mined, the land bridge will be <br />wet mined from north to south and an additional acreage reduction will be requested, <br />accordingly. <br />We hope the above information and attached supporting documentation are sufficient for <br />DMG to rule favorably on this Acreage Reduction Request.
