December 5, 2004 Bromley AR-002 Page 2 of 2 The post-mining land use in the approved reclamation plan is for (unsealed) open lake/wildlife habitat. As you can see, the City wishes to implement a different post- mining land use. Both parties seek a way to efficiently accomplish the City's desired end use. Causing Ready Mixed to perform reclamation under the DMG permit that maybe inconsistent with the City's future plans and/or immediately destroyed by the City's construction activities makes little sense. To further simplify and expedite this request from an administrative perspective, Ready Mixed is not, at this time, seeking a bond reduction in conjunction with this Acreage Reduction request. To support this request, we have attached a new Exhibit A -Legal Description for incorporation into the revised pennit. This in turn is supported by a map showing the new configuration of the permit boundary per the proposed new legal description. These attachments indicate that the proposed new permit area will comprise approximately 172.5 acres and that a total of 220.0 acres will be released from the permit. One detail of interest is that the acreage to be released per this request is in two halves that will comprise the City's Cell No. 1: the easterly half comprising approximately 49.5 acres and a westerly half comprising approximately 170.5 acres. The land between these halves will constitute a "land bridge" from the Bromley Lakes Pit (this permit) to an adjoining Ready Mixed property called Erger's Pond Pit ((DMG Permit M-1998-036). Erger's Pond Pit is currently unmined and has no separate access or haul routes. Under the approved Erger's Pond permit, material mined there is to be processed at the existing Bromley Lakes Pit plant facilities. Once Erger's Pond is mined, the land bridge will be wet mined from north to south and an additional acreage reduction will be requested, accordingly. We hope the above information and attached supporting documentation are sufficient for DMG to rule favorably on this Acreage Reduction Request.
