No. 1 and would not be affected by mining activities due to its location. In 1989, the operator requested via Technical Revision No. 10 (TR-10) to terminate hydrologic monitoring. They cited the lack of identifiable impacts from monitoring conducted up to 1989, the lack of mining activity since 1984, and the influence of historic mining activity as evidence to support their request. The operator presented previous Hydrologic Monitoring Reports in support of their position. Division review of the 1986 Annual Hydrology Report (R. Price, April 1987) "did not show any significant trends that would indicate adverse hydrologic impact due to the current mine since the establishment of baseline. " Review of the 1987 Annual Hydrology Report (J. Stevens, Sept. 1988) revealed the finding that "water level and water yualiry data (which) appear generally compatible with that previously reported. Impacts of the mining on local surface and groundwater resources do not seem to be increasing. " Based upon Division review and the conclusion that mining had no identifiable impact on the surface or groundwater regime, Technical Revision No. ]0 (TR-10) was approved in April 1989. All exploration drill holes and groundwater monitoring wells have been reclaimed. Exhibit 9 of the approved permit application contains the abandonment reports submitted to the Division, which contain reclamation information for 1989 and 1993. SUMMARY AND CONCLUSIONS In summary, Kaiser Ventures, Inc. has completed the reclamation plan as currently approved in the permit. The reclaimed lands have achieved the vegetation necessary to meet or exceed the required standards of the approved reclamation plan and the approved post-mining land-use of rangeland. The reclaimed azea blends well into the surrounding area, even to the degree that the reclaimed area is difficult to discern from the undisturbed area. The reclamation appears to be capable of supporting managed grazing. Revegetation appears sufficient to control erosion at the site. There is no further reclamation work remaining or contemplated at this site. No issues or problems were identified as a result of the bond release inspection. Based on the observations and findings as detailed above, the Division proposes to approve Kaiser's request for a Phase III bond release for the CCM No. 1. Any person with a valid legal interest which might be adversely affected by this proposed decision may request a formal public hearing before the Mined Land Reclamation Board in accordance with Rule 3.03.2(6). Public notice of this proposed decision will be published twice in the Huerfano World for two weeks as soon as possible. Requests for public hearing must be submitted to [he Division in writing within thirty days of the first publication of the public notice. If no hearing is requested, the Division's decision will become final andjurisdiction will terminate at the site.
