<br />PROPOSED DECISION <br />As required by Rule 3.03.2(5)(a), this document constitutes written notification of the Colorado <br />Division of Minerals and Geology (the Division) decision to approve a Phase III bond release <br />request for the Colorado Coal Mine No. 1 (CCM No. 1), permit no. C-81-024. The application <br />was submitted by Kaiser Ventures, Inc. (Kaiser). The rationale for this approval is as outlined <br />below. <br />Any person with a valid legal interest which might be adversely affected by this proposed <br />decision may request a formal public hearing before the Mined Land Reclamation Board in <br />accordance with Rule 3.03.2(6). Public notice of this proposed decision will be published twice <br />in the Huerfano World as soon as possible. Requests for public hearing must be submitted to the <br />Division in writing within 30 days of the first publication in the Huerfano World. If no hearing is <br />requested within 30 days, [he Division's decision will become final and the Division's <br />}urisdiction over the site will terminate in accordance with Rule 3.03.3. <br />BACKGROUND <br />The CCM No. 1 is a surface mine located in Huerfano Counry, northwest of the town of <br />Walsenburg, in portions of sections 25 and 36, T27S, R67W. <br />Legal Description of Colorado Coal Mine No. 1 Permit Area <br />Township 27 South, Range 67 West <br />Beginning at a point at the NW comer of Section 25, Township 27 South, Range 67 West, <br />Huerfano County, Colorado <br />thence S 87° 16' 1" E 1518 feet; <br />thence S 37° 56' 13" E 6605 feet; <br />thence S 3° 17' 1" W 189 feet; <br />thence N 89° 45' 44" W 5397 fee[; <br />thence N 1° 47' 6" W 5448 feet. <br />Containing 437 acres more or less. <br />Seventy-three and one-half acres were disturbed and reclaimed at this site. The land for which final <br />bond release has been requested is privately owned by Kaiser, and coal that was mined from the <br />area was privately owned. Reclamation of areas for which bond release has been requested was <br />completed during November 1989 (main disturbance) and February 1992 (sediment control ditches <br />and ponds). This final bond release request includes all of the 73.5 acres originally disturbed and <br />reclaimed. <br />
