Long <br />Re: New Elk Mine (Permit No. C-81-012) Division Director <br />Technical Revision Application No. 44 (TR-44) <br />Change Reference Areas <br />Dear S'u or Madam: <br />The Division of Minerals and Geology hereby issues notice, N accordance with Title 34, Article 33, Section 116, Paragraph 4, <br />of the Colorado Revised Statutes, that on November 12, 1999, an application to revise coal mining operations at the New Elk <br />Mine was considered complete for the purposes of filing. The revision was submitted by Picketw've Processing, LLC. All <br />review and comment periods as provided in the Act and the Regulations initiate from [his date of filing. <br />This revision establishes revegeta[ion reference areas to be used for comparison with reclaimed lands to determine the success <br />of those reclaimed areas. Reference area vegetation is sampled typically once annually during the growing season. No <br />disturbance other than vegetation analysis will occur. <br />The underground coal mining operation is on land located approximately 25 miles west of Trinidad, Colorado. The permit area <br />is further described as follows: <br />Township 33 South, Range 67 West <br />Sections 30 and 31 <br />Township 34 South, Range 67 West <br />Section 6 <br />Township 33 South, Range 68 West <br />Sections 13, 14, 21, 22, 23, 24, 25, 26, 27, 28, 34, 35, and 36 <br />Township 34 South, Range 68 West <br />Sections 1 and 2 <br />All sections are partially or fully projected by Basin Resources due to the unsurveyed nature of the Maxwell Land Grant. <br />The above-mentioned trace of land are shown on the USGS 7.5 minute Quadrangle maps of Vigil. <br />A copy of the technical revision application is available for public inspection at the Las Animas County Courthouse, 200 East <br />First Street, Room 104, Trinidad, CO 81082, and at the Division office. For additional information or to provide written <br />comments, contact the Division of Minerals and Geology, Room 215, 1313 Sherman Street, Denver, Colorado 80203, <br />(303) 866-3567. In order for us to comply with regulatory time frames, we request that comments be submitted within fifteen <br />(15) days of this letter.
