Conduct raptor nesting survey at the level of detail described in the <br />attached proposal. <br />a. One time helicopter inventory. <br />b. Follow-up ground surveys. <br />MITIGATION <br />1. Use of raptor data to determine appropriateness of mitigation measures <br />such as artificial nest structures. <br />2. Continuation of the elk mitigation study for 5 years. <br />3. Preserve existing surface water within draws. <br />4. Off-site treatment and subsequent monitoring of mountain shrub <br />communities with roto-clear to increase available browse. <br />5. Use of live-handled topsoil and transplanting of select mature <br />transplants with front end loader to improve native tree and shrub <br />establishment. <br />6. Re-establish or maintain 40Y of the mine plan area to similar premine <br />cover types. <br />a. Approximately 20% cover (aspen or mountain shrub) left in <br />undisturbed islands. <br />b. Re-establish the other 20Y cover through appropriate techniques. <br />It is my understanding that a meeting has been scheduled next Thursday, <br />December 20 at 1:00 p.m. in our office to discuss this matter. I look forward <br />to personally discussing this matter with you at that time. I assure you that <br />CYCC will conduct the mining and reclamation operations on the Little Middle <br />Creek Tract using the same standards of excellence we have used in the past. I <br />expect we will be able to resolve any differences of opinion in our meeting next <br />Thursday; however, should problems arise, I would like to discuss with you the <br />options available to obtain a speedy resolution of this important matter. <br />Hopefully, this letter has summarized the importance and concern we place <br />on obtaining a prompt resolution to this matter. Due to our time constraints, <br />we anticipate receiving written confirmation from you acknowledging whether or <br />not our proposals are acceptable. In the event that some items cannot be <br />resolved, we would expect to receive conditional approval for those items that <br />are acceptable and an explanation of those proposals you do not consider <br />acceptable at this time. We will expect to receive this reply by January 15, <br />1985. Our goal will be to resubmit additional information on the areas you <br />consider deficient by February 1, 1985, so we can have the issue formally <br />resolved by February 15, 1985. <br />w~~.._ _... _....>~.~ _.,._ <br />
