The new objective <br />is: <br />4.16.3(5) <br />Plans for postmining Land use shall be desi,~red under the general <br />supervision of a registered professional egineer, or other <br />algarvpriate professional, who will ensure that the plans cronform <br />to applicable accepted standards for adequate Iand stability, <br />foundation support, drainage, vegetative cover, and esthetic <br />design appropriate for the postmining use of the site. <br />4.16.6 <br />The proposed use will not present actual or probable hazard to <br />public health or safety nor will it pose any actual or probable <br />threat of Hater fl ay diminution of pollution. <br />A road is defined by CMLF~ as meaning "a surface right~f-way for purposes <br />of travel by land vehicles used in coal exploratien or surface coal minim <br />and reclamation operations". A road includes the entire area within the <br />right-of-way, including the road had, shoulders, parking and side area, <br />approach structure, ditches, surface and such contiguous appendages as are <br />necessary for the total structure. <br />Using the CMLRD road definition as a technical guide, Sun Coal Company <br />decommissioned the road. <br />Sun Coal has decommissioned the haul road to comply with the general <br />provisions of rule 4.03 and the Division's specifications for long - term <br />maintenance. Interior ditches were improved, road surface graded to permit <br />outslope drainage and culverts, inlets and outlets were designed to <br />support the post mine land use. Topsoil was redistributed over part of <br />the haul xvad width aryl was reseeded, mulched aryl fertilized. Because the <br />road now slopes to the outside for drainage, a berm in specified areas, <br />was left in order to provide for public safety pursuant to rule 4.16.3.(b) <br />stated above. <br />Since the road is an approved post mine land use and to be left in an <br />approved disturbed condition, Phase II and III revegetation success <br />~~ri'"=' <br />.J .:. ...J'_~ <br />
