This is also a continuation of the informal conference initiated <br />September 20, 1985 by the lamowner, Mr. John Eilts, aryl resporxls to your <br />subsequent letter dated September 25, 1985. <br />It is Sun Coal's position that it has done everything to satisfy the Phase <br />I and Phase II baarl release requirmients for the backfilled git area and <br />the decaanissioned haul road. The following is presented to substantiate <br />this position. <br />The Regulations of the Colorado Mined Land Reclamation Board for Coal <br />Mining outlines the followirg schedule for performance bond release: <br />3.03.12) <br />The ,na~r; mrmr liability under performance bonds applicable to an <br />increment or a penait area gdiich may tae released shall tae limited <br />to the following schedule: <br />(a) UP to sixty percent of the total taorri amount applicable <br />to an increment or permit area shall be released when the <br />permittee successfully completes t~ckf~lling, regrading, and <br />drainage control of a bonded area in accordance with his <br />approved reclamation plan; <br />(bJ Up to eighty-five percent of the total bond amount <br />applicable to an incnsn?nt or a permit area shall be released <br />upon the successful establishment of revegetation in <br />acc»rdance with the appznved reclamation plan.
