The regulations consider underground <br />development waste to be coal mine waste and; therefore, the design <br />must comply with Rules 4.10, 4.09.1, 4.09.2 and 4.11. <br />The Division has the following comments and questions regarding <br />this application, which must be addressed before the Division can <br />make a decision to approve this application. <br />DESIGN AND CONSTRUCTION <br />1. LPG-103G and LPG-104G are required to be certified by a <br />registered professional engineer, as the maps are a part of <br />the design for the fill (4.09.1(2)). Please provide certified <br />copies of these maps. <br />2. Does the disposal area contain any springs, natural or manmade <br />water courses, or wet-weather seeps? If so, then an <br />underdrain system should be constructed to prevent <br />infiltration of the water into the spoil material <br />(4.09.1(13)). <br />3. MCC is required to demonstrate that the coal mine waste is <br />non-toxic and non-acid forming (4.09.1(12)(b)). This <br />information should be provided. <br />4. Where will be the source for rock for the underdrain? Rule <br />4.09.2(2)(a) requires that the underdrain consist of non- <br />degradable, non-acid or toxic-forming rock such as natural <br />sand and gravel, sandstone or limestone. Other durable rock <br />may be used, if it has been demonstrated not to slake in water <br />° D <br />0-i3- 9y <br />
