This is a report of findings and a request for infornation as a result of an internal review of the Bear,
C-81-033 Applicant Violator System (AVS) databank and internal files. In this memo, requests for
documentation means letters of appointment, letters of resignation, minutes of board meetings, etc.
Attachment I is a schematic of organizations that "owns or controls" the applicant according to
informa[iou in the AVS da[abanl:. Attachment 2 is AVS information regarding the permit.
Attachment 3 is AVS information regarding Bear Coal Co Inc (CO).
Information (a page number 2.03-8R, dated 6/98) in the Colorado Division of Minerals and Geology
(CDMG) AVS files is that William A. Bear was appointed Sr. President and Director as of August
1, 1997, and that Daniel E. Bear was appointed President and Director as of August 1, 1997. Other
appointements as of August 1, 1997 were Basil R. Beaz as Vice President, Secretary and Director,
Richazd W. Conkle as Vice-President, Secretary & Director, and Willam A. Bear Jr. as Treasurer,
Assistant Secretary and Director. Information on pge number 2.03-8R continues that Willam A
Bear, jr resinged his position on February 9, 1998. Existing AVS entries postdate the information
of page number 2.03-8R for the following appointments: Daniel E Bear as President (02/25/1998).
Richard W. Conkle as a Director, Secretary and Vice-President (02/25/1998). A number of
companies reappoint officers at annual meetings, but I don't know if this is one of them. To post
the AVS databank in compliance with our MOU with OSM, however, documentation is required.
Please provide me with information, including docurentation, to resolve the following
discrepancies, entries, etc. The CDMG AVS files contain no documentation.
