As the application recites, the section of <br />the road proposed to be widened "... slopes at about 1.1:1 (h:v) down to the <br />North Fork Gunnison River." This road is the haulroad over which all Bear <br />Coal's product coal is transported. <br />In accordance with Rule 4.03.1(3)(d)(ix) of our regulations, portions of this <br />outslope will exceed 0.5:1 (h:v) scope and must be the subject of an <br />appropriate geotechnical stability analysis. In response to our earlier <br />preliminary comments, the applicant's consultant engineer, Mr. Conrad H. <br />Parrish (Colorado PE No. 17932) of ACZ, Inc., submitted a supplemental <br />statement, atesting to the stability of the amended road embankment <br />configuration. Further, in accordance with Rule 4.03.1(d) of our regulations, <br />the reconstruction of the haul road will have to be inspected and certified by <br />an appropriately qualified registered professional engineer. <br />/ph <br />cc: Bob Liddle <br />Doc.
