Long <br />Division Director <br />The Colorado Division of Minerals and Geology proposes to approve your <br />technical revision application (portal road - slide repair plan) for the Bear <br />Mine (our File C-81-033). Notice of the proposed decision will be published <br />as soon as possible. The publication will initiate the ten (10) day public <br />comment period for the Division's decision. <br />Be aware that the slide repair measures proposed by Bear Coal are considered <br />by the Division to be the least acceptable mitigation measures. Bear Coal <br />Company and the Division will monitor the success of these mitigation measures <br />in stabilizing the landslide area. If proven inadequate, Bear Coal may be <br />required to undertake further slide repair measures. <br />Please realize that future slide occurrences may result in the issuance of a <br />notice of violation and also that a slide occurrence on the reclaimed mine <br />area, during the ten-year reclamation liability period, will reinitiate that <br />period beginning with the date the slide area is repaired. <br />The Division strongly suggests that Bear Coal Company consider implementing <br />slide mitigation measures, in addition to those committed to in TR-14, to <br />provide additional insurance against reoccurring landslides. <br />If you have any questions, please contact me. <br />Sincerely, <br />..~! <br />Steve S.
