<br />25-7-101. Short title. This article shall be known and may <br />be cited as the "Colorado Air Quality Control Act". <br />25-7-102. Legislative declaration. In order to foster the <br />health, welfare, convenience, and comfort of the inhabitants of <br />the state of Colorado and to facilitate the enjoyment and use of <br />the scenic and natural resources of the state, it is declared to <br />be the policy of this state to achieve the maximum practical <br />degree of air purity in every portion of the state, to attain and <br />maintain the national ambient a.ir quality standards, and to pre- <br />vent the significant deterioration of air quality in those por- <br />tions of the state where the air quality is better than the <br />national ambient air quality standards. To that end, it is the <br />purpose of this article to require the use of all available prac- <br />tical methods which are technologically feasible and economically <br />reasonable so as to reduce, prevent, and control air pollution <br />throughout the state of Colorado; to require the development of <br />an air quality control program in which the benefits of the air <br />pollution control measures utilized bear a reasonable relation- <br />ship to the economic, environmental, and energy impacts and other <br />C costs of such measures; and to maintain a cooperative program <br />between the state and local units of government. It is further <br />declared that the prevention, abatement, and control of air pol- <br />lution in each portion of the state are matters of statewide con- <br />cern and are affected with a public interest and that the provi- <br />sions of this article are enacted in the exercise of the police <br />powers of this state for the purpose of protecting the health, <br />peace, safety, and general welfare of Ehe people of this state. <br />25-7-103. Definitions. (1) "Air pollutant" means any <br />fume, smoke, particulate matter, vapor, or gas or any combination <br />thereof which is emitted into or otherwise enters the atmosphere, <br />including, but not limited to, any physical, chemical, biologi- <br />cal, radioactive (including source material, special nuclear <br />material, and by-product material) substance or matter, but "air <br />pollutant" does not include water vapor or steam condensate. <br />(2) "Air pollution control authority" means the division, <br />or any person or agency given authority by the division, or a <br />local governmental unit duly authorized with respect to air pol- _ <br />lution'control. <br />(3) "Air pollution source" means any source whatsoever at, <br />from, or by reason of which there is emitted or discharged into <br />the atmosphere any air pollutant. <br />(4) "Allowable emissions" means the emission rate calcu- <br />lated for a stationary source using the maximum rated capacity of <br />
