<br />Memo [o Greed Squire 2 Aoril 7 2000 <br />• The ripped shale must be mixed and blended with overburden and placed and compacted in thin <br />lifts. The attached estimating form for scraper work yields a cost for this task of $104,735.00, <br />including the cost for moisture conditioning, blending and grading of lifts, and compaction. <br />• Quality assurance testing and observation at $500.00 per day for 20 days yields a cost of $10,000.00 <br />for the project. <br />• A cost must also be included for the installation of the inter-reservoir culvert. At $47.30 per foot <br />for 24" HDPE pipe over 150 feet a cost of $7095.00 is estimated (unit cost from 1999 Means Site <br />Work and Landscape Cost Data, division 026 680 0900). The estimated cost for installation of a <br />butterfly valve is $6522.00 from 1999 Means division 026 404 3630. The estimated cos[ [o install a <br />utility vault for the valve assembly is $4050.00 from 1999 Means division 026 054 0300. <br />• A cost to install reservoir maintenance roads must also be included. There is insufficient detail in <br />the amendment application on the type of roads that will be installed for the Division to estimate <br />this cos[. The Applicant should provide a general design for the roads and an estimate of [heir <br />installation costs for the Division to review. <br />3. The application states that the dike and the pond shores will slope at 3:1 for 10 vertical feet below <br />the maximum reservoir water level, then at 2:1 thereafter. The 3:1 slopes should be extended to 10 <br />vertical feet below the ordinary low water mark anticipated for the reservoirs. Given the shallow <br />depth of the reservoirs, it would probably be expedient to assume that 3:1 inslopes will be required <br />throughout. The amendment application does not address the potential for erosion at the reservoir <br />perimeters. The mixed shale and overburden backfill will probably require some armoring to <br />protect it from wave action. The Applicant should address this issue and provide a proposal for <br />armoring and an estimated cost for its installation. <br />4. The ground surface elevation falls 25 feet from the north end of Reservoir 1 to the south end of <br />Reservoir 2. Given the topography of the site and the configuration of the proposed reservoir banks <br />and dike, the dike may be considered ajurisdictional dam upon release of the Mined Land <br />Reclamation Pennit. The Applicant must obtain a finding on this issue from the Dam Safety <br />Section of the Office of the State Engineer and provide documentation of the finding to the <br />Division. In any case, the Division of Minerals and Geology has primacy over dam safety issues <br />within reclamation permit boundaries. As such, the Division requires detailed designs, plans, <br />specifications, aquality assurance plan, and construction reporting and certification for the <br />installation of the reservoirs. Spillways may be a necessary component to assure dam safety. In <br />order to avoid duplicative regulation, the Division will consider deferring to the State Engineer on <br />these issues if it can be demonstrated to the Division's satisfaction that the reservoir design and <br />construction will be regulated by the State Engineer for the duration of the Mined Land <br />Reclamation Permit. <br />5. Since the proposed reservoirs are perched above the water table, i[ is not necessazy to install liners <br />to prevent injury to water rights. As such, the Applicant is eligible, if they so desire, to apply for an <br />alternative reclamation plan that would be executed by [he Division in the event of a bond <br />forfeiture. In other words, the Applicant would be free to develop the proposed reservoirs once the <br />
