. ~ -. <br />Proposed Decision <br />The Division proposes to approve Rock castle Coal Company's request for <br />partial bond release. Specifically, the Division proposes to release <br />$437,69ti trom the $572,000 reclamation liability. This decision <br />represents a release of bond and liability for backfilling and grading of <br />overburden and partial topsoiling which has occurred at Pit 4. This <br />decision on release noes not extend to the area of Pit 4 immediately east <br />of Pond 4, or the Pit 4 haul road. This request was made by Rock castle <br />Coal Company in accordance with Rules 3.02.2(4)(d) ana 3.03.2 of the <br />Regulations of the Colorado Mined Land Reclamation Board for Coal Mining <br />and Colorado Surtace Coal Mining Reclamation Act. C.R.S. 34-33-101 et <br />seq. Section 125. <br />The Grassy Gap Mine is located in Township 5N, Range 87W of the 6th Prime <br />Meridian in the following sections: <br />Section 20: E 1/2 SE 1/4, E 1/2 NW 1/4 SE 1/4 SE 1/4 <br />Section 21: W 1/2 SW 14 <br />Section 28: W 1/L NW 1/4 <br />Section 29: E 1/2 NW 1/4, NE 1/4, S 1/2 <br />Section 31: E 1/2 SE 1/4 NE 1/4, NE 1/4 NE 1/4 <br />Section 32: NW 1/2 <br />This area is contained within the Mount Harris ana Dunckley 7 1/2 minute <br />USGS quadrangle maps. Bond release is being granted on backfilling and <br />graaing performed on 15.22 acres of the 1080.6 acre permit area, <br />otherwise known as Pit 4. This area is locates in the E 1/2 SE 1/4 <br />Section 20. <br />This proposed decision is based on a site inspection conducted September <br />6 and 7, 1590, as well as review of the monitoring and permit files, and <br />information submitted by Rock castle concerning volumes of earthwork. The <br />Rockcastle company provided information that 527,345 loose cubic yards <br />had been moved by September 6, 1990, the date of CMLRD's inspection. <br />Therefore using the agreed to factor of $0.83 /bcy, the Division proposes <br />that $437,696 be released from the $572,000 bond. Therefore, $134,304 <br />will be retained to conduct the remaining reclamation. <br />0585E <br />
