I have reviewed the information you sent. The mining company recognizes that they will be using water beyond the
allowed uses and amounts decreed in their augmentation plan for case number 97CW138. Consequently, they have
tiled for a temporary substitute water supply plan with our office dated June 22, 2004. It is currently under review by
our staff. If you would like a copy of the proposed new plan, please let us know. Once the new plan is approved by
our office, the mining company can proceed with water uses in accordance with the approval. Ultimately, the mining
company will have to file for a permanent plan with the water court. If you have any additional questions, you can
contact Craig Lis of this office or myself.

I talked to Jim Kiger at Oxbow today. He said the total water taken out of the North Fork of the Gunnison alluvium
infiltration gallery by Oxbow in the last 1.5 to 2.0 years varies from a low of almost 5 million gallons per month up
to a high of almost 13 million gallons per month. The water that is taken out of the river by Oxbow is, then,
distributed to the mine and to the town of Somerset. Of the almost 5 million gallons per month, the mine used 4.5
million gallons and the town used almost 500,000 gallons per month. Of the 13 million gallons per month, the mine
used 12 million gallons per month and the town used almost 1 million gallons per month. Jim Kiger said that the
local water commissioner comes around once a month and records the monthly intake of river water.

Thanks Joe, this is the information we needed. The Division Engineer for Water Division 4 is out until Monday
so I have not been able to talk to him to determine if the operation has been in compliance with this decree.
Do you have any information on the amount of water diverted by the diversion structure that serves the town
