The mining company recognizes that they will be using water beyond the <br />allowed uses and amounts decreed in their augmentation plan for case number 97CW138. Consequently, they have <br />tiled for a temporary substitute water supply plan with our office dated June 22, 2004. It is currently under review by <br />our staff. If you would like a copy of the proposed new plan, please let us know. Once the new plan is approved by <br />our office, the mining company can proceed with water uses in accordance with the approval. Ultimately, the mining <br />company will have to file for a permanent plan with the water court. He said the total water taken out of the North Fork of the Gunnison alluvium <br />infiltration gallery by Oxbow in the last 1.5 to 2.0 years varies from a low of almost 5 million gallons per month up <br />to a high of almost 13 million gallons per month. The water that is taken out of the river by Oxbow is, then, <br />distributed to the mine and to the town of Somerset. Of the almost 5 million gallons per month, the mine used 4.5 <br />million gallons and the town used almost 500,000 gallons per month. Of the 13 million gallons per month, the mine <br />used 12 million gallons per month and the town used almost 1 million gallons per month.
