Measurements were made and methods were di: mitigate potential erosion from two areas of the F berm and sedimentation to the Middle Fork of the Soi River. The two areas were (1) where the berm is a< the Middle Fork of the South Platte River and (2) berm is adjacent to wetlands area vegetation directions from area (1). RRI has not committed to protecting this portion of the berm. Prior to this time the MLRD was not as concerned abo t erosion and sedimentation from this area. We felt that the egetation between the berm and the stream would trap eroded ma erial and prevent most of it from reaching the stream. Howeve , the DOW feels that the wetlands vegetation could be damage and that sediment could reach the stream. Since this would onstitute off site damage and could constitute a violation, the MLRD agrees that this area should also be protected. An cceptable compromise would be to provide mechanical protection of all areas outside of the areas to be rip-rapped ra her than completely revegetating these outslopes. This echanical control could be accomplished with jute erosio control blanket, excelsior mat or a similar method tat would stabilize the slope for the 2-3 year period befo a grading occurs. Please state clearly what commitments RRI will make to stabilize the berm. Pursuant to your request, the configuration of "area Rio. 1" is provided in the attached report. For "area No. 2", RRI points out that in a letter from t e MLRD to the DOW dated April 18, 1990, the MLRD concluded that dditional erosion control is not necessary because of the "buffer f shrubs, grasses, and forbes on the gentle slopes between the be and the stream". RRI agreed with that conclusion.
