With those two berms, all run-off from the subject <br />area is being controlled, although not being channelled to <br />Pond B. You may recall that Division staff inspected these <br />two berms, when it was decided to add an additional row of hay <br />bales, in addition to the silt fence, to each to fortify the <br />structures. We apologize that the location of the two berms, <br />although being in place for quite some time, was not shown on <br />any drawings. <br />9-10) The portion of Ditch #6, which flows in an <br />easterly direction, away from Pond B, is outside the disturbed <br />and only carries run-off from the non-disturbed portions of <br />these particular lands. Run-off from the area, which was <br />disturbed during the mine development, topsoil pile #6, is <br />directed in a westerly direction into Pond B. <br />As agreed with the Division, all ditches and drainage <br />structures will be resurveyed in the spring of 1995, following <br />the settling of the ground and structures. Ditches will then <br />be recut and cleaned to conform with the specifications. <br />lla-c) NCIG cannot explain why the Division has not <br />received the subject documents. Mr. Rovey advised the company <br />that a set of 3 documents for Exhibit 4.7-1, dated December 5, <br />1994, was mailed to the Division on the same day. Upon advice <br />by the Division that such documents have not been received, a <br />second set was hand delivered. At the December 12, 1994, <br />meeting between Mr. Rovey and Division staff, Mr. Rovey <br />submitted another set of the subject documents, as the hand <br />delivered set could not be located. Since your December 15, <br />1994, letter states that the documents have not been received, <br />a fourth set is included herewith. <br />NCIG agrees to the stipulation that the performance of <br />the various drainage structures will be closely monitored and <br />reevaluated in the spring of 1995. Arrangements have been <br />made with Mr. Rovey for a detailed inspection immediatedly <br />following the snow melt on the site. <br />20c) Figure 4.7-3, attached, shows the location of the <br />roads, which were left in place. <br />Please note that page 4-56 is being resubmitted as the <br />original page contained a couple of typographical errors. <br />Sincerely, <br />,C /Gf~V /'"6C~c~~ <br />E.
