Box 880 <br />Trinidad, Colorado 81082 <br />Re: Surface Owner Approval of Proposed Post-Mining Land Use al <br />Former Burlington Northern Railroad Lease Area . <br />(Lands located in Section 7, T.33S., R.63W., East of old foundry) <br />Dear Mr. Cordova: <br />@ifi~„~~!(~s~f~ce <br />Over the past several yeses, Energy Fuels Mining Company (EPMC) has operated the Raton Creek Mine <br />and associated rail loadouts located in the vicinity of Trinidad, Colorado. As you may be aware, due to <br />adverse coal market conditions and various operational factors EFMC has filed a notice of permanent <br />cessation of operations with the Colorado Division of Minerals end Geology (DMG): In older to minimize <br />the poteiitial for adverse environmental impacts end resteire the effected lands to prodtctive posfmining use <br />EFMC is in process of reclaiming all mining related site disturbance in accordance with plans presented in <br />the existing approved permit and in compliance with all applicable regulatory requirements. <br />Site reclamation of the subject lands, completed in 1991, included demolition and removal of all facilities <br />and reestablishment of surface drainage patterns. Each of Utese activities was designed to protect the <br />environment end restore effected lands to productive postmining lend use. <br />As a surface landowner, we recognize that proposed postmining land use is important to you. For the above <br />referenced former rail loadout site, proposed reclamation activities were designed to restore effected lands to <br />a postmining land use of ' industrial". The proposed use is consistent with both the premining use and <br />existing land use plans and zoning designations. <br />If the proposed postmining land use is consistent with your desire and intent, please verify your approval by <br />your signature below and return one (1) signed wpy to the following address: <br />Energy Fuels Mining Company <br />P.O.
