Cattany
Greenwood Village, CO 80111 Dlvislon Do-ector
Re: Final Adequacy Item, Technical Revision TR-09
Lorencito Coal Company, The Lorencito Canyon Mine
DMG Petmit No. C-96-084
Deaz Mr. Kolin:
Our December 19, 2002 adequacy letter pertaining to Lorencito Coal Company Technical Revision TR-09 identified
the following adequacy item: "17(a). The response is inadequate. It is our understanding that the information
requested for Map 2.05.3-5 regarding the dates of installation of the coat bed methane wells and pipelines has not yet
been obtained from Evergeen. Please provide a revised (and certified) Map 2.05.3-5 that includes this information
once the information is obtained".
On January 6, 2003, we received Crteystone's response dated January 3, 2003. This letter stated, "Upon receiving the
information from Evergreen Resources, regarding the dates of installation of the coal bed methane wells and pipelines,
Map 2.05.3-5 will be updated and submitted".
We to date have not received this information, and we brought this item to your attention via a telephone conversation
today. 1t is our understanding that Evergreen Resources has not responded to a letter from Greystone dated December
11, 2002 requesting the well and pipeline installation information, and that this information could be some time in
coming. Because the Division is in the process of reviewing a Permit Renewal (RN-01}for the Lorencito Canyon
Mine, there maybe several proposed pages from the both the Technical Revision and the Permit Renewal that may
conflict with each other. To avoid this potential administrative problem, I have decided that the Division should
address the remaining TR-09 adequacy item pertaining to well and pipeline installation information separately from
TR-09. In doing so, this does not mean this issue is resolved; only that this item will be addressed with Lorencito
Coal Company via a Division process separate from Technical Revision TR-09. As the well and pipeline installation
information was the last unresolved adequacy item regarding Technical Revision TR-09, I have, under separate letter,
decided to proceed with proposing approval of Technical Revision TR-09.
Please feel free to contact me at (303) 866-4933 if you have any questions regarding this matter.
Sincerely,
.~~t,~t,~.~r~ r
Daniel I.
