CMC <br />would like to propose that the alternative raised in the Division's April 25, 1996 letter be formally <br />considered by the Division. Specifically, CMC will withdraw permit amendment for the proposed <br />combined treatment facility, instead maintaining the facilities, financial warranty, or some combination of <br />both so that a water treatment facility to treat only Henderson Mine water would be available in the event <br />of bond forfeiture by CMC. <br />CMC will commit to the necessary permit conditions and financial warranties for water treatment at the <br />Henderson Mine site and rescind Amendment Application AM-02 currently under consideration by the <br />Division. However, we request a determination by the Division that under such a scenario, the water <br />treatment plan[ at Urad is not subject to the requirements of a reclamation permit. <br />We appreciate the Division's willingness to work towards finding practical solutions to the issues raised by <br />this amendment.
