Long <br />RE: Technical Adequacy Review of Technical Revision 002, Permit No. #M-89-065, Winkler Light Div6wn Director <br />Aggregate Quarry <br />Dear Mr. Opheim, <br />This letter is being written to inform you that the technical revision submitted by your company on <br />October 12, 1999, must be modified into an Amendment application in order to be approved in its curtent <br />form. Technical Revision 002, Permit No. #M-89-065, Winkler Light Aggregate Quarry, has been <br />examined by the Division of Minerals and Geology (DMG) in light of the newest information submitted <br />to us by Tuttle-Applegate. Specifically, the fact that the affected area will be increased by 54.22 acres due <br />to the pushing back of the excavation boundaries. According to Rule l.l(6) of the Construction Materials <br />Rules and Regulations, an Amendment to a permit means "a change in the permit or an application which <br />increases the acreage of the affected land, or which has a significant effect upon the approved or proposed <br />Reclamation Plan." While the changes applied for in your initial Technical Revision application will not <br />result in a change to the perrnit acreage, they will change the affected acreage, and thus an Amendment <br />application is required in order to incorporate the proposed changes. <br />At this time, you may withdraw your application for this Technical Revision and re-submit an application <br />for an Amendment to your permit, with the appropriate public notices and proofs of filing. If an <br />Amendment application is submitted within 30 days, we will be able to apply the $150.00 fee submitted <br />for this Technical Revision to the $1,550.00 fee required to process your Amendment application. Or you <br />may extend the decision date of this Technical Revision application in order to reconsider the changes you <br />wish to make to the curtent permit. It should be understood, however, that if this Revision is not <br />withdrawn or the decision date extended by November 19, 1999, DMG will deny it based upon the above <br />cited Rule. <br />If you have any further questions, please feel free to contact me at (303) 866-3567. <br />Sincerely, <br />~~, ~ .
