Cattany <br />Division Director <br />Natural Resource Tmstee <br />The Division received your responses for Technical Revision 03 (TR-03) for the S & H Mine, Permit <br />Number M-2000-158. The Division of Minerals and Geology (Division) is required to make an approval <br />or denial decision no later than January 3, 2006, therefore, your response to the following adequacy <br />review concerns should be submitted to the Division as soon as possible. <br />1. The operator proposes to leave an existing 25 to 35 foot road as a component of the reclamation plan. <br />The Division was unable to find agreements in the permit file to keep the roads in place once mining <br />is complete. Section 34-32.5-116(4)(a) of the Colorado Land Reclamation Act for the Extraction of <br />Construction Material states that grading shall be carried on so to create a final topogaphy <br />appropriate to the final post-extraction land use selected (wildlife habitat and developed water <br />resources). The Division does not believe that leaving a road 25-35 feet wide is compatible with the <br />proposed post mining land use. The operator has the following options; <br />o As an alternative to leaving the haul roads in their current configuration, the operator may opt to <br />reduce the width of the haul roads to be more compatible with the end land use, or <br />o provide documentation from Weld County or the Town of Milliken stating that a 25 to 35 foot <br />wide road conforms to their local building and zoning codes. Such documentation must be a <br />letter from Weld County or the Town of Milliken stating that the road left in place will meet the <br />zoning requirements and the approved post-mining land use. <br />2. Please submit the surface use agreement between Platte Sand & Gravel LLC and Kerr-McGee that <br />contain notarized documents in accordance with Rule 6.4.19(a) or Rule 6.4.19(c). Alternatively, the <br />Operator may provide an engineering plan for each proposed utility crossing for which an acceptable <br />notarized document is not obtained. <br />3. It is the Division's understanding that the existing topsoil pile has been in place for over one year. <br />Please state how the pile is protected to prevent wind and water erosion. Please demonstrate <br />compliance in the form of receipts for seeding, seed tags or photogaphs of stabilization measures. <br />Please be aware that the original mine plan does not contain the location of all future topsoil piles. <br />Please revise the map to depict the location of future piles. <br />Please be advised that TR-03 Application may be deemed inadequate, and the application may be denied <br />on January 3, 2006 unless the above-mentioned adequacy review items are addressed to the satisfaction of <br />the Division.
