<br />Appendix 43-C (Continued) <br />MEMORANDUM OF UNDERSTANDING • <br />BETWEEN THE TEXAS DEPARTMENT OF HEALTH <br />AND THE RAILROAD COMMISSION OF TEXAS <br />REGARDING URANIUM SURFACE MINING AND MILLING <br />5. TDH licenses will contain a provision that licensees must comply with <br />RRC permit requirements. RRC permits will contain a provision that <br />permittees must comply with TDH license requiresents which protect <br />occupational and public health and safety and the environment. <br />6. The TDH will require reporting of spills pursuant to Texas Regulations <br />for the Control of Radiation promulgated by the Texas Board of Health. <br />7. The RRC and the TDH may coordinate inspections, sampling programs, and <br />enforcement actions. <br />8. The technical staff of the RRC and the TDH will cooperate so that <br />their highest level of technical expertise will be available to assess <br />environmental impacts, attend public hearings, and enforce the respec- <br />tive agencies' mandates. <br />9. The RRC and the TDH agree to review and .revise their respective rules <br />and procedures as needed to implement this MOU. <br />10. Agency representatives shall meet, as needed, but no less than • <br />annually, to discuss possible changes in this MOU and to encourage <br />increased communication between the agencies. <br />11. Nothing in this MOU shall be construed to reduce the statutory juris- <br />diction of either agency. Nothing in this MOU shall be construed to <br />reduce the statutory jurisdiction of the TWC to regulate activities <br />relating to exploration and recovery of uranium by surface mining or <br />in situ mining. <br />12.
