The RRC shall ensure that the proposed activities meet the RRC standards; determine the adequacy of pre-operational information provided by the appli- cant; assess the degree of environmental impact that would result from the proposed activity; issue permits and permit revisions and renewals; and enforce all the RRC permit conditions and standards, including the maintenance of financial security for activities for which the RRC is directly responsible. (b) The RRC and the TDH shall be jointly responsible for, from both radiological and nonradiological considerations, the regulation of releases and disposal of mine effluents, mine drainages, and other wastes resulting from uranium surface mining, and shall both require incident notification by the permittee or licensee. Regulation relating to all surface discharges of effluents or other liquid or solid streams from the mining areas shall be determined in cooperation with TWC, which also has responsibility over nonradiological aspects and impact of such releases. The RRC shall have the primary responsibility for regulation of reclamation and revegetation activities, and for subsequent • release of the affected land. The TDH will perform radiological surveys of the reclaimed areas and advise the RRC of their findings. 2. ORE MILLING (a) The TDH shall have responsibility for licensing and enforcement activities for the ore milling process plant facilities starting from the raw ore receipt and storage to the packing and transpor- tation of the uranium oxide concentrate. The TDH shall ensure that the proposed activities meet TDH standards; determine the adequacy of radiological and nonradiological pre-operational information provided, and assess their impact on public health and safety and the environment; review the applicant's design, construction, operation, monitoring, record keeping, reporting, maintenance, closure, and post-closure activities, including decommissioning and reclamation, to ensure that they meet TDH standards; address environmental impacts resulting from the proposed activities in a TDH-prepared Environmental Assessment; and issue licenses and enforce all TDH license conditions and standards, including determination and maintenance of financial security for activities for which the TDH is directly respon- sible. 43 - 34 (April 1990)
