Appendix 43-B (Continued) • MEMORANDUM OF UNDERSTANDING ON IN SITU URANIUM MINING BETWEEN - THE TEXAS DEPARTMENT OF HEALTH AND THE TEXAS WATER COMMISSION 10. Requirements for financial security for decontamination, decommis- sioning, stabilization, reclamation, maintenance, surveillance, control, storage, and disposal of radioactive materials of the below , and above ground site to specified radiological and chemical levels shall be established jointly by the TWC and the TDH. Posting of financial security with the TDH shall include funds for restoration as agreed with the TWC. 11. The TWC will require financial assurances for plugging and abandonment of injection and disposal wells. 12. The TWC will specify in its permits the parameters to be met for aquifer restoration. Radiological parameters will be set by the TDH. Nonradiological parameters will be set by the TWC. The TWC shall be responsible for regulation of groundwater monitoring, excursion detec- tion and response, and groundwater restoration. 13. The TDH, after consultation with the TWC, will specify in ita licenses the parameters to be met in surface reclamation, decontamination, and • decommissioning. The TDH shall have primary responsibility fur regu- lation of surface reclamation, decontamination, and decommissioning. 14. Technical staffs of the TWC and the TDH will cooperate so that their highest level of technical expertise will be available to assess environmental impacts and enforce the agencies' mandates. 15, In the event that financial security or assurances deposited in the Radiation and Perpetual Care Fund as provided herein are required to complete decontamination, decommissioning, stabilization, reclamation, maintenance, surveillance, control, storage, and disposal of radio- active material, the TDH, in agreement with the TWC, may enter into contracts to accomplish these activities. Payment for such contract services may be made from the Radiation and Perpetual Care Fund upon order of the TDH when the contract terms are satisfactorily completed, 16, The TWC and the TDH agree to review and revise their respective rules and procedures as needed to implement this MOU. 17, Agency representatives shall meet, as needed, but no less than annually, to discuss possible changes in this MOU and to encourage increased communication between the agencies. 18, Nothing in this MOU shall be construed to reduce the statutory juris- diction of either agency. Nothing in this MOU shall be construed to reduce the statutory jurisdiction of the RRC to regulate activities • relating to exploration for uranium. 43 - 31 (April 1990)
