<br />Appendix 43-B (Continued) <br />• MEMORANDUM OF UNDERSTANDING ON <br />IN SITU URANIUM MINING BETWEEN <br />- THE TEXAS DEPARTMENT OF HEALTH AND <br />THE TEXAS WATER COMMISSION <br />10. Requirements for financial security for decontamination, decommis- <br />sioning, stabilization, reclamation, maintenance, surveillance, <br />control, storage, and disposal of radioactive materials of the below , <br />and above ground site to specified radiological and chemical levels <br />shall be established jointly by the TWC and the TDH. Posting of <br />financial security with the TDH shall include funds for restoration as <br />agreed with the TWC. <br />11. The TWC will require financial assurances for plugging and abandonment <br />of injection and disposal wells. <br />12. The TWC will specify in its permits the parameters to be met for <br />aquifer restoration. Radiological parameters will be set by the TDH. <br />Nonradiological parameters will be set by the TWC. The TWC shall be <br />responsible for regulation of groundwater monitoring, excursion detec- <br />tion and response, and groundwater restoration. <br />13. The TDH, after consultation with the TWC, will specify in ita licenses <br />the parameters to be met in surface reclamation, decontamination, and <br />• decommissioning. The TDH shall have primary responsibility fur regu- <br />lation of surface reclamation, decontamination, and decommissioning. <br />14. Technical staffs of the TWC and the TDH will cooperate so that their <br />highest level of technical expertise will be available to assess <br />environmental impacts and enforce the agencies' mandates. <br />15, In the event that financial security or assurances deposited in the <br />Radiation and Perpetual Care Fund as provided herein are required to <br />complete decontamination, decommissioning, stabilization, reclamation, <br />maintenance, surveillance, control, storage, and disposal of radio- <br />active material, the TDH, in agreement with the TWC, may enter into <br />contracts to accomplish these activities. Payment for such contract <br />services may be made from the Radiation and Perpetual Care Fund upon <br />order of the TDH when the contract terms are satisfactorily completed, <br />16, The TWC and the TDH agree to review and revise their respective rules <br />and procedures as needed to implement this MOU. <br />17, Agency representatives shall meet, as needed, but no less than <br />annually, to discuss possible changes in this MOU and to encourage <br />increased communication between the agencies. <br />18, Nothing in this MOU shall be construed to reduce the statutory juris- <br />diction of either agency. Nothing in this MOU shall be construed to <br />reduce the statutory jurisdiction of the RRC to regulate activities <br />• relating to exploration for uranium. <br />43 - 31 (April 1990) <br />
