43.40(d) ~J (d) The following methods for the verification of 43.40(c) are acceptable: (1) The transferor may have in his possession, and read, a current • copy of the transferee's specific license or registration certif- icate; (2) The transferor may have in his possession a written certification by the transferee that he is authorized by the license or certif- icate of registration to receive the type, form, and quantity of radioactive material to be transferred, specifying the license or registration certificate number, issuing agency and expiration date; (3) For emergency shipments, the transferor may accept oral certifi- cation by the transferee that he is authorized by license or registration certificate to receive the type, form, and quantity of radioactive material to be transferred, specifying the license or registration certificate number, issuing agency, and expira- tion date, provided that the oral certification is confirmed in writing within ten days; or (4) When none of the methods of verification in 43.40(d)(1) through (3) are readily available or when a transferor desires to verify that information received by one of these methods is correct or up-to-date, the transferor may obtain and record confirmation from the Agency, the Commission, or the licensing agency of an Agreement State that the transferee is licensed Lo receive the • radioactive material. (e) Preparation for shipment and transport of radioactive material shall be in accordance with the provisions of 41.23 and 41.100. 43.50 Modification, Revocation, and Termination of Licenses (a) The terms and conditions of all licenses shall be subject to amend- ment, revision, or modification, or the license may be suspended or revoked by reason of amendments to the Act or rules and orders issued by the Agency. (b) Any license may be revoked, suspended, or modified, in whole or in part for: (1) any material false statement in the application or in any state- ment of fact required under provisions of the Act; (2) conditions revealed by such application or statement of fact or any report, record, or inspection, or other means which would warrant the Agency's refusal to issue a license on an original application; or (3) violation of or failure to observe any of the provisions of the Act, of the license, or of any rule or order of the Agency. • 43 - 12 (April 1990)
