Applicant has participated in several proceedings <br />in this court to protect its conditional decrees and to <br />distinguish between its conditional decrees and related <br />decrees owned by others. <br />5. Through diversion facilities constructed at the <br />point of diversion for the Synthetic Products Ditch right by <br />Colorado-Ute Electric Association, Applicant has diverted <br />and applie3 to beneficial uses, 1.0 c.f.s of the Synthetic <br />Products Ditch decree and hereby requests that such portion <br />of its conditional decree be made absolute. Such diver- <br />sions, delivered pursuant to the Fuel Agreement through <br />facilities constructed by Colorado-Ute Electric Association, <br />commenced December 17, 1979 and are continuing. <br />Based upon the foregoing, this applicant respectfully <br />requests that findings of reasonable diligence be made as <br />provided by law.
