Hydrologic Monitoring Program <br />Termination <br />Dear Ms. Binns: <br />Colorado Yampa Coal Company is requesting a technical revision to the above referenced permit to terminate <br />the Hydrologic Monitoring Program. Our rational for this request is based on the following: <br />1. Phase II bond release is completed, and Phase III bond release is partially completed. <br />2. Spoil spring discharges continue to be in compliance. <br />3. All site discharges are already being monitored under NPDES Permit No. CO-0027154. These <br />sites are listed below: <br />39 Pond A 84 Pond D 55 Pond G <br />63 Pond B 85 Pond E 57 Pond H <br />83 Pond C 87 Pand F 80 Pond T <br />4. The Foidel Creek drainage has no alluvial valley floor areas, and therefore no material damage <br />criteria. <br />5. There are no downstream impacts of site discharges. <br />6. Bedrock water levels and quality have stabilized since mining. <br />7. Most sites in this program are duplicated in Permit No. C-82-056 and will thus continue to be <br />monitored. Listed below are the only sites which will no longer be monitored: <br />Bedrock Wells Sooil Wells <br />94M001 001-SP-6 <br />94M002 001-SP-7 <br />026-SF-1 <br />026-SP-2 <br />026-SP-3 <br />Spoil Springs <br />A2 <br />B3 <br />C1 <br />D Comp <br />E <br />114 <br />It is our opinion that continued hydrologic monitoring under this permit will contribute nothing new to the <br />extensive period of record data already reported in the AHR's. <br />Please call me at (970) 870-2750 if you have any questions or require additional information. <br />Sincerely, <br />tephen L.
