The Division accepts BMRI's <br />response to stipulation numbers 1, 2, 3, 4, 6 and 7, with the <br />following comments/requirements: <br />1) Stipulation No. 3: BMRI states that the volume of waste <br />rock placed into the West Pit will be reported to the <br />Division on a monthly basis. It is not the intent of the <br />Division to require monthly reporting from BMRI regarding <br />the amount of waste rock being placed in the West Pit. The <br />Division will only need to know the volume of waste rock if <br />it has to be removed (pursuant to Stipulation No. 1) The <br />Division will gladly accept monthly reports but they are <br />not required. <br />2) Stipulation No. 7: The Division received the Proposed <br />Monitoring and Water Quality Evaluation Plan fmr the West <br />Pit which was prepared by Halepaska and Associates. <br />Comments and/or concerns will be submitted to BMRI in the <br />near future. <br />BMRI's response to Stipulation No. 5 did not adequately address the <br />questions. According to Figure F-2 of TR-018, there is going to be <br />an outlet area on the south side of the West Pit which, after the pit <br />is backfilled, will allow surface runoff to exit the pit area. The <br />question I have is where will the surface runoff go once it exits the <br />pit area? It appears there are two possible scenarios. The runoff <br />could follow the county road to the west but will, ultimately, cross <br />over and end up in the Rito Seco. Or, the runoff may exit the outlet <br />area, cross the county road, and flow directly into the Rito Seco. <br />In order to protect the Rito Seco from sediment runoff, the Division <br />needs to know the direction of surface runoff once it leaves the pit <br />area. The Division recognizes that BMRI committed to controlling <br />sediment runoff from the partially backfilled pit with BMP's but made <br />
