corrected, certified and submitted for approval, including cross-section information and plan <br />view information for the pond. Information from the CYCC permit #C-81-071 in Exhibit <br />13 should be submitted as appropriate and accurate. <br />TCC response (Pond B) <br />The design of this pond was modified by a submittal of a revision to the Division, a <br />copy of which is attached for incorporation into Exhibit F. As noted in the approved <br />revision, the pond is identified as a treatment facility. The approval states 'The <br />division therefore finds that Pond B has been designed, constructed and maintained <br />to contain or treat the volume of water from active mining areas which result from <br />a 10-year, 24-hour precipitation event". The pond was recently surveyed and TCC <br />is awaiting the final drawings which will be used to prepare the P.E. certification for <br />this structure. Surveying the pond was complicated by the fact that it contains water <br />and a boat had to be used to assist in the work. <br />Division response (Pond B) <br />TCC did not submit the information requested. Furthermore, the "design" <br />information that was submitted as Exhibit F is for a configuration that has a <br />maximum disturbed acreage of 3 acres. I believe this is no longer true when the <br />ROM coal stockpile area is considered. Additionally, in the January 27, 1982 <br />correspondence from Sandy Emrich to R. A. Domingue, Ms. Emrich asks specifically <br />for "design drawing of the pond system...showing... front and side views of the <br />principle and emergenry spillways" and a variety of information for Cell C. If this <br />information exists, TCC should identify and submit it. <br />Pond <br />Pond C information from the CYCC permit should be incorporated into the Foidel Creek <br />mine permit. As-built certification documents on file with the Division consists of <br />construction inspection notes from Robert Thompson, P.E.. An as-built P.E. certification <br />statement done in accordance with the policy memo is required. <br />TCC response Lond C)C) <br />The design and construction notes from CTL/Thompson are attached and can be <br />inserted into Exhibit 8G.
