Cattany <br />Division Director <br />Natural Rewurce Trustee <br />Tom, this memorandum is a review of Kent's comments as to how well the questions proposed <br />convey my concerns as expressed in my memorandum of April 25, 2006.. I recommend <br />rewording and additional wording as follows in bold. These comments were discussed with Kent <br />on May 9, and with Henry Barbe on May 10, 2006. Henry and I agree that all these issues were <br />discussed and courses of action agreed curing the telephone conference call held on May 9. <br />Therefore, no additional written correspondence is necessary with regard to this memorandum. <br />To item 86a, change the first sentence to read: A map showing the proposed workings, <br />location and configuration of structures and renewable resource lands, and each survey <br />monument is required. Rule 2.05.6(6)(c)(ii). This map is a good place to show the areal <br />extent of predicted subsidence related phenomena within the permit and adjacent area as <br />well [Rule 2.05.6(6)(e)(i)(F)(IV)]. <br />To item 86b, add: The lists of structures and renewable resources that exist within the <br />proposed permit and adjacent areas are not consistent. Lists or items are presented on <br />pages 2.05-109, 2.05-143, 2.05-146, 2.05-148, and pages 19, 21, and 23 of Exhibit 60B. Please <br />reconcile the lists, or make one list with references to the single list at other times. Please <br />consider removing landslides and rockfalls from the lists of structures and renewable <br />resources, and treat them as areas of special interest for monitoring. Rule 2.05.6(6)(a) <br />West Elk is going to monument and monitor landslides and rockfalls. <br />Item 18. I disagree with Kent to some extent. The Monument Dam is a structure in an adjacent <br />area of the permit. As it is on the list of structures, Rule 2.05.6(6)(b) requires a description of the <br />worst possible consequences which subsidence, if it occurred, could have on the structure. The <br />statement that mining will not affect the Minn Res. is part of the subsidence control plan.
